H1 extension and I94 expiration

Hi everybody,

My I94 is due to expire soon. My H1-extension was filed in february and has not been approved yet (CSC is processing Jan cases). My question is:

Can I overstay I94 if my H1 extension has been filed?
Would I still be considered in status?
Since my GC is also being processded, I do not want to screw this one up.

Thanks

During the extension pending period a person can stay here for not more than 180 days.

If an H1 extension is filed, then you can stay here with the receipt and work for your employer till a decision is made. Your new I94, if approved, will be from the date of your existing I-94. So not to worry abt it.
