H1 expiring, H4-H1 question for wife.

Folks .. here's my situation. My H1b is expiring late 2006. My wife was on H1b 2 years ago, and is now on H4 since last 2 years. My question to you is - if she applies for H1b (probably in 2005 against 2006 quota, since quota is almost done for 2005) would she have another 6 years on her H1b?

Also, would I be able to convert mine to H4 after my H1b expires (assuming my wife starts working on H1b again)?

Hi OOZ............YOU CAN BE ON H(H1 OR H4) for 6 yrs total .being on either one of those starts the clock .........So i guess if your wife has had 2 yrs of h1 plus 2 yrs of h4 ...then she can get another 2 yrs worth of H1 only !!you cannot get another 6 yrs.......tho you might b able to get a 7th yr extension if you have your green card underway ........

Ah .. you got me there. I was hopeful based on the rule that you get another 6 years on H1b if you are not on H1b for 1 year or more. But I guess the rule must be .. " ... if you are not on H1* for 1 year of more".
 
No, converting F1 won't reset the six year clock. You will be able to stay in US though.

To reset the 6 year clock, you have to be physically out of US for a year.
