H1 Expiring and Labor Certification

Would appreciate if i could be enlightened on the following:

My 6 years H1 expires in Nov 2004. My attorney will be filing for
my labor (Regular - Non RIR) next week in Texas.
Can i then apply for 7th year extension/8th year extension of
my H1 since my labor is pending for more than 365 days OR is it necessary that my labor should have progressed to some level
to get benefit of this rule?
All inputs would be highly appreciated.

Yes , you can apply for a 7th yr extension if your labor has been pending for more than 365 days , but I think you should hurry and file your labor as you have to cross the 365 days mark and then apply for your extension(H1) and should probably leave some buffer .
