H1 expires 07/30, file concurrently?

Hi All,

I have just got my labor approved (EB3 RIR, old system filed 03/24/2005) and employer is going to submit I140 PP.

1. Should I go with I140/I1485 concurrent filing? Are any benefits or drawbacks?
2. What is the benefit for doing premium I140 in this case (planning to file on June 15th)
3. My H1B(7th year) will expire in July 30th 2007, so while I140 is pending, can I extend my H1B for 1 year or 3 years?

Any suggestions would be greatly appreciated.

Answers are below:

1. Either way is fine, I-485 can be filed after July 1, 2007.
2. I-140 PP is beneficial for AC-21 portability.
3. You will keep getting 1 year increments (even after I-140 is approved) based on your LC filing date, till your I-485 is adjudicated.
 
Hi to All,

I got my RIR Labor Cert approved last Dec 2006.And I am planning to file both I140 and 1485 together.Heres my questions:

1. Do you think my Approved labor cert is still valid or not dead because what I read is that it should be within 180 days after the approved labor cert before you can file the I140 process?

2. Do you think its much better to have i140 premium process first to be able to know if you are not denied and proceed next to I 485?

3. Or its better to file both of them together?
