H1 entry question

my friend is working in UK he has a US H1 visa expiring on Dec 15 2002. He is planning to come back to US in 1st week of December around 6th or 7th of December.

Is that OK or he would have any problems entering into US as his H1 would be Valid only a week from then ??
He did not applied for GC or any thing.

He can come into the country NO PROBLEM but he will get his I94 till Dec 15. So he has to apply for H1 renewal ASAP once he in the country or else he will be out of status.
