Hi Everyone,

I have been trying to find answer to this question, but there have been mixed responses. Here is the situation - I have about 3.5 yrs of H1 period left and my first 3 years approval expires in 6 months. I have valid EAD/AP and now I am planning to work on EAD for one year project and leaving my current H1 job. Now after one year, if I plan to come back on H1, what will I have to do? Do I just file for transfer with new employer? Will that be considered new H1 and fall into quota? Will I have to go out of country and enter on H1 just to start working on H1?

It Will not fall into the quota since you have obtained number within last six years. You may need to travel out side US either for stamping or new I-94.
Also you have pending I-485 you can get back on H1 even after six years.
