Hi all,
My wife is on H4 and we applied for H1b for FY 2005 through a desi consultant. Unfortunately the visa was rejected (premium processing) after one RFE (for which we submitted the documents). The reasons were:
1. the employees job description is very generic in the h1 application and H1 is for skilled employment.
2. my wife got a subcontract-ed project for 3 months and so we pushed the regular h1 file to premium processing. another reason given was that in the contract document for the 3 months project there is no good description of the job.
3.the consultant has office in Wisconsin and why is the employee woring in california?
the consultant is now advising us to go for an "appeal". I check this forum and some other websites based which i have the following questions:
1. What is the success rate of an h1b appeal?
2. how long does it take to know an answer?
3. what are the disadvantages involved if the appeal is rejected?
4. will a rejected "appeal" afffect future visa changes?
It would be of great help to us if someone case share their valuable knowledge in this regard.
