H1 confusion while I-140 is pending.

Hi All,

This might be a bit off the topic but I trust your collective wisdom. I have been a full time employee except for a brief period of time (from Oct 2003 - Feb 2004). My lawyer has applied for an amended H1 in Oct 2003 and it has been approved now with the starting date of May 10 2004 till 2006. In the meanwhile, I got a full time project from April 2004 and am continuing in that now. My 140 has been applied in Dec 2003. I have my EAD but don't want to use it. What do I do now? Should I ask my lawyer to reapply for another H1B? I had an H1 B till 2006 prior to the approval of this. Will this new H1 take over the old one? I am also planning to change jobs in the near future.

I am sooooo confused..

Gurus, please let me know what should I do???

Get some 'Preparation H (1B)' and hope the entire process is less painful!




Okay, getting serious!! If u plan to stay with current employer for long, apply for H1b transfer. Hope u are not planning on leaving the country! If no, then wait till to finally find the job u like and then ask them to sponspor H-1b transfer.

But then again, Im not a lawyer so I may not be giving the best advice!
