H1 cancelled ... URGENT

Hi,
Iam on H4. Though i got H1 approval in 2008, i never used it (never on H1). I went to my home country in 2010 and returned in jan 2011 after 8 months. I want to do job now. when i called my employer he said he canceled my H1 (without informing me). Can i ask my employer to return my H1 fees i paid for ($2500)? and can I file a complaint at DOL?. Iam concerned bec Iam on H4 all the time.

Why did you never use it? Is it because of you, or because of the employer? If it was because of you then there's nothing much to do about it.
You can complain to the USCIS re the $2500. You shouldn't have paid a penny, by law.
Since more than 1 year past, you cannot transfer it, you need to request a new visa.
