My brother was on H1 and 6 months back moved to canada on work permit. He still has an I94 with him. I guess he has to file new H1 if he has to work in US but I assume he wont hit the cap since he can be filed under his previous H1 cap. Am I correct? Second, does he has to surrender his I94 before filing new H1. Any response is appreciated. Thanks.
