I am going to complete my 6 years and applying for 7th year extension.
I came here 1998, June 16th. I suppose to complete 6 years by 2004, June 15th. Note: I never traveled to India after I came here.
When I changed my job, my new H1 tranfer has validity upto April 28th, 2004 only, still I have balance of 45 days appox.
My old employer filed my LC which is pending more than a year.
My current employer filed my LC again in April 2003 still not completed 365 days.
Question I have:
Q1. Since my LC is still pending more than a year filed by my previous employer, can I use that LC instead of waiting for new LC to complete 365 days pending rule?
Q2: Who has to file 7th year ext. ? Current employer or previous employer?
Q3. If current employer files, any issues with it? ex: RFE etc:,
Q4. Since I have balance of 45 days, can I apply directly 7 year ext without asking that balance or I have to renew my h1 first , complete 6years then I should apply for 7 th year extension?
or can I ask INS to include those days with my 7th year extension?
Q5: If at all, I have to renew the balance of H1 period, is there any timing restriction on 7th year extension?
What I mean, first I have to apply for H1 , once I get it and apply 7th year extension or apply both H1 and 7th year in the same time etc.,
So many questions.
