My wife was working on an H1-B till November'2008 when she was laid off. As a result, she left the US for 4 months and came back on an H4 upon our marriage in February. She had around an year left on her H1-B when she was laid off and the PERM process had been initiated (not that its relevant at this point). My question regarding our situation is as follows:
I have heard that if you are out of the country for an year, you have the option of applying for a fresh H1-B visa contingent to the annual cap. Can she do that if she is on an H4 for an year? In other words, if she gets a job in October will she be able to get a fresh H1-B with a validity of 6years?
