Hi,

Thank you all for helping people like me by your quick replies. My case is like this. I came here is Chicago on 2005 August for doing my M.S. I am working in Construction Company from Oct. 2006. I filed my H1B visa on the basis of my Indian master’s degree in April 2007. I got my approval for h1b visa. ( 60,000 H1B In between I complete my Master of science from USA in May 2007. Now I am on H1B visa based on my Indian education. Can I go to Canada for my visa stamping? Is it necessary for visa stamping from Canada that one have h1b visa based on my USA master degree?

Thank you,

Chilal

I don't think the LCA or I-129 petition mentions if the degree is from US/India.
If you have completed your masters from US and have certificate with you then you do qualify for stamping from Canada. Mention it on your copy of resume and also tell it to consular officer during interview.
Good luck.

I would like to clarify for everyone's sake here.
I do not believe that you need a US degree to go for Consular Processing to Canada/Mexico.

Any individual, irrespective of where they earned their education, can go for stamping to Canada/Mexico.

Having Masters here or there or anywhere is not the basis of "qualification" for H1B Stamping. It is difficult for them to evaluate your qualification, if you have education is outside of Canada or US - It is case by case basis. Make sure you carry education evaluation.
