I have a question about H1-B visa renewal.
On the U.S. Department of State web site you may see following rule: "The Visa Office considers existing visas for revalidation when they are within sixty days of expiration. Visas received for revalidation before that sixty-day period are returned without revalidation."
But on this forum I see that revalidation process takes around 6 months.
My H1-B expiration month is 12/2003, also my I-94 expiration month is again 12/2003.
If I apply for revalidation 2 months of expiration and the process takes 6 months, this will exceed may I-94 expiration date.
The question is:
If I apply for revalidation 10/2003, may I stay in the US, if my H1-B revalidation is pending, even my I-94 is already expired.
