H1-B visa for citizenship

I have an approval notice from INS for my 2nd H1-B (extension of the 1st 3yr H1-B), but my lawyer did not file the petition on time for the 2nd one. I had 10 days of illegal status.

One of my friend informed me that I will be eligible for US citizenship if I complete 6 years of H1-B status and 1 year contract of employment afterwords.

Currently I am trying to change my sponsor of my H1-B, and my lawyer is telling me as long as I go back to my country once and get my passport stamped at American Embassy, everything will be fine.

Would I be still eligible for citizenship despite my illegal status? How would this 10 day illegal status will affect me? My lawyer is telling me everything is fine, but I want to get someone else's opinions.

Would someone give me advise what I should do? Thank you very much for your help.

Someone gave you a load of crap. You cannot become eligible for citizenship after completing 6 years in H1. You need to be a US permanent resident for 5 years (3 years if married to a US citizen).

Thank you nkm-oct23. I thought so, but I had to check. Does any one can advise me on 10 days illegal period?

Thanks again
