H1-B visa and Procedure for applying for GC through Premanent Residence

Hi All,

I am currently on H1-B visa. I just changed my company and how I am working for the new company. I have already received my approval notice from the INS. I have a valid visa stamp till July 2003 in my passport from the previous employer.

I am going to India next week for three weeks. Can you tell me if it is a good idea to get the stamp done from ahmedabad, Gujarat, India or should I do the stamping from here in usa. What are the procedures for stamping in India.

Also I recently got married to a permanent Residence(GC). My wife is studing and she is on green card. I want to know which is a better and safe way to apply for my GC. Is it through employer or through my wife. Also what forms do I need and where do I have to send those forms.

How much time does it take for getting the GC through my wife who is on green card or through my employer.
Also tell me what documents to send when getting the revalidation done for the new employer back in India.

My suggestion is that you should get the stamp in USA if you have time.
To answer your q on GC filing - if your employer is willing to file, do it through employer, because if you file through your wife ( who is a Green Card holder and NOT US citizen) then it will take you at least 6-7 years to get your Green Card.
If your wife is becoming citizen soon you can file through her.
