Hi,

I entered the US in September'00 on H1-B visa.Since Dec '00 - till date I have been on a
project in Australia on behalf of my parent company which is chicago based.Althrough this
while, I have been paid by my employer in the US,payroll and paystub are generated in the
US as my employer is based in Chicago.During this tenure,my entire cumulated period of stay
in the US has been less than a month and a half as I have been travelling at the client
sites in Australia.

Now my question is whether this period (Oct00 - till date ) is counted towards my H1-b
limit of 6 years in the US.WHAT DOES THE 6 year limit mean.

Thanks in advance for your reply

If you can prove that you were on a project, assigned by your H1 petitioner company, your days out side USA are not counted towards your H1. Only physically present days are counted. There are some debates on the vacation days though. But that wouldn't apply to you since you are on a business assignment anyway.

Good luck!
