H1-B Transfer RFE and New Job offer

Hello sir,


I was employed by company Z till Feb 15th 09 and they filed my cancellation after that. I applied for Visa Transfer through a consultant company X and (submitted my application on March 3rd 09) received a long RFE on March 12th.
In the meantime I was interviewing and company Y have made an offer to me today on March 13th. I told them that they can file my H1-B transfer since I am employed by company X. But given the RFE i seriously doubt if my H1-B transfer application would even be approved for company X.

What are my options if my RFE for company X doesn't approve? What should I ask Company Y to do?

Please advice.

Since you are no longer employed by your original employer, what needs to be filed in my opinion is a new cap-exempt petition and not a transfer petition. But, that is my opinion.
