hello
I have got an h1b approved from a co starting Oct 2005 (it was h4 to h1b ).
got a permanent offer from another Co .but they want me to start on Jan 3rd 2006 .
Meanwhile i have not recd any paystubs from the current co since no project .and I havent even recd My SSN yet
So now to be safe when should i apply for the transfer .Should i do it now so i can say i havent recd my ssn and so no paystubs also .in that case will the transfer be approved witt start date of 2006.
Or should i wait till nov end and then apply for the transfer.

Please provide some suggestions
Thanks

While I am not sure what is best in your case, past paychecks may not always be necessary for H1 transfer. There is one case I know of in the past (with vermont cis, within the last 24 months) where the transfer was done without past paystubs (the lawyer correctly suggested these weren't needed and didn't enclose them with the application). Not sure if this is generally true for Vermont CIS cases.

At the time of the above case, a couple of other lawyers (who were consulted for second opinion) seemed to think that paystubs are always necessary. Just goes to show that there may be diverse opinions out there. Your peace of mind might be best served by consulting a good lawyer, with the emphasis being on good.

Hope this helped. Good luck.

H1b transfer-

I am also in same situation, I just got my new H1 approved this October 1-st.Now i came to know that the company which filed my H1 is closing down.
Just wanted to know whether its possible for me to transfer my H1 to a new company, without having any pay stubs..
any new information about this scenario will be greatly appreciated..
Thanks in advance
