i had an H1-B approval and valid visa from company A which is valid till october 1, 2007.
I intended to transfer to company B who filed for my H1-B transfer in october 2006 first under normal processing but converted to premium processing after 3 months, which had multiple queries and later on rejected. Now company B has appealed against the rejection. Company B has been running my payroll ever since they got approval notice in october 2006. Now i am in dilemma. here are the few questions i need to be answered.
1) As my old H1-B from company A is still valid till october 2007, i am running out of time. I already waited close 9 months for this transfer. which is pending based upon an appeal. How soon will this case likely be decided ? what likely hood it has to be approved based on appeal ?
2) can company B file altogether a fresh H1-B petition, as its earlier petition is rejected ?
3) can I go back to my old company A, and what are the chances i have to get an extension which is due in october 2007. ?
4) If i want a fresh H1-B transfer petition from company C to be filed, as i don't have recent paystubs from company A who has a legally approved status for me, but i have all paystubs from company B who has an petition rejected and appealed , what are the chances the petition will be approved?
5) am I being in serious danger be going out of status, if i wait for the appeal to be resolved if it takes another 2-3 months?
please let me know if any other good options i can look into .
