Hi,

I do not want to continue with the employer A who is filing my H1. I recently received the H1 approval but I want to work for another employer B who is ready to hire me and get my H1 transferred. Problem is that I do not have any documents like I-797 from employer and he wouldnt give those to me.

I only have the receipt number (EAC number). Could you tell me if just by using that number I can get it transferred or do I need some other documents?

THanks a lot for your help.

Best,
DE

Is this a new petition for October 2009? In such a case, the new employer has to file a cap exempt petition, mentioning the previous receipt number.

I agree. I wanted to know if I need a copy of I-797 for transfer. I do not have it and I will have to ask my employer for that. But I do have my EAC number or receipt number. Can't I get a transfer just with the EAC number?
