I would appreciate if you could please respond back to my following query !!.
I am in India and the situation is like this:
In case a person has got the H1B petition approved by employer "A" however he/she hasnt gone for stamping yet. Now he/she changes the job in India itself and employer B wants to file H1 for him/her however the H1B quota is already over. Can they use the originally approved petition (which Employer A made) and request for the transfer of employer. If yes what are the risks involved with the visa stamping?
I have the petition details which I can pass over to Employer B. Can they use those details and file for H1 transfer(even if I did not go for H1 stamping yet) because the quota is over and they want me to be there ASAP.
Also if they can then will the employer A come to know about it??
