H1 B Transfer -ACADEMIC H1B to (CAP H1 B)

Dear Reader,

I have a question.

One lawyer came to our university through the international office and Announced boldly that an H1B Visa obtained through a university CANNOT be Transferred to a H1B Quota of Industry ( With CAP)

IS this TRUE ??


IF NOT

IN what situation can the H1B be transferred from Non-Cap OR Academic Quota to the Quota with CAP ???
 
The academic H-1B is NOT transferrable to industrial H-1B. H-1Bs can be transferred to another university I think since there is no cap for academic environment.

This is a gray area and will depend on the interpretation by the USCIS officer. But relying only on this will not be a good idea.
If cap is not reached then you can get it transferred without any problem.

Thanks for the update.

That means that if I get an Academic H1B then I am always stuck with University ?

Because it is predicted that the CAP for MS-PhD QUota this year has already been reached.

The Universities know this and have started offering pays which are lower than even janitors who work and clean.
