H1 B Tranfer (Urgent, Please help..)

Hi,

My h1 is about to expire in May 14th, 2004. My current employer has not filed for my extension yet.

However, I decided to change the employer. My new employer is willing to file for h1 B transfer with premium processing.

I have the following concerns.

1. Is it Ok to file for transfer with out filing for extension??
2. When can I start working with the new employer??
3. Is it legal to stay in the country if my current H1 expires and transfer is pending??

I appreciate any help on this.

Yes, you can do a transfer to the company B H-1B provided they file a new petition on your behalf. You can start working for the second company as soon as you get the receipt notice, showing that the USCIS has received the new H-1B petition. You can do all this without company A having to file an extension on your behalf, and you can remain in the US pending the adjudication of the second H-1B provided it is timely filed (before the current H-1B expires)
