H1 B status quesiton

Hello all, I need some expert opinion regarding my case. I started working for my new employer on 1/9/2006, and my new company's immigration folks had already filed for my H1b transfer on 1/6/2006. However couple weeks later I find out that the INS made a mistake on their side and processed the case as new H1B rather than transfer and reject my H1b since the new h1b quota was exhausted (I have a feeling that my lawyer screwed up). Immedialty my lawyer filed for new H1b transfer again and I got the approval with receipt date of 1/30/2006 and h1b validity from 2/6/2006 - 1/30/2008. In addition, I found out that my old employer hadn't cancelled my H1b and it was still valid while I was working with my new employer. However, from 1/9/2006 I was on my new company's payroll.

Questions:
1) Was I out of status between 1/9/2006 - 1/30/2006?
2) What can I do to mitigate any risk if I am getting my H1-b stamping done?
3) What should I put the start date as on the forms I fill for my H1b stamping?
4) Will it help If I can get a letter from my old employer stating that my end date was 1/29/2006? And a letter from my new employer stating that my start date was 1/30/2006? However in this case, I only have pay stubs from old employer till 1/6/2006 and new employer's pay stubs mentions start date of 1/9/2006.

I am in a fix and I am very confused about the plight of my case when I do for H1b stamping. Any expert opinion will help me a great deal.
