Does any one have an experience of getting a H1-B visa after getting laid off and immediately getting a new job. The GAP is about 4-5 Weeks.

I would appreciate if any one can give their input.

I am facing the same situation and looking for some guidance, I was working for Comp A and was not getting paid on bench so applied and filed for a job with Comp B - which sponserd my H1 Transfer. My H1 Transfer was approved, but no I-94 because I could not produce 3 weeks of paystubs. so I have to go Consulate in India.

I am trying to get experience...on this ....

I have all my paystubs and everything... except for those 3weeks. I appplied for -797 at that time and got an Approved I-797 with a valid I 94 also. This was all about 2.5 years ago. I have been with this company now for 2.5 years and have been on STATUS. Travelled to india back and forth couple of times.....

Any guidance apppreciated.....

How about vacation leave...

Is it possible to show that you have taken vacation for those 3 weeks. I heard some people do this way. Also, when the company is not informing INS about the lay off, you may say you were on vacation. Just a try.
