H1 B revalidation

My current H1B visa is expiring in October. I would like to find out if I need to obtain a new I-797 before I can file for visa revalidation. I was under the impression that I can send my passport and current I-797 with the other required documents to renew my H1B visa for another 3 years, but I am a little confused by what my company HR person says. I would appreciate if someone could clear this up for me.

Hi Kanu,

You have to first apply for H1 extension.... once u get ur i-797 approved, then you have to send ur passport and the copy of i-797 to St Louis for stamping.....

If you havenot applied so far ..... do it asap....

further question on H1B revalidation

Thanks GC Rawal. If I apply for H1 B eextension now and the approval comes through after my visa has expired. Will I be considered out of status for the period in between. Can I still apply for a visa revalidation with the new I-797 by mail.
