Hi,
I have applied for h1-b visa, my name was there in the lottery, when i went for visa stamping, my case was put on hold, later on i got a
letter from US Embassy in India saying that your case is rejected due to your petitioner does not appear to be either able or willing to provide qualifying employment in the US in accordance with appropriate laws and regulations.
In this case, when it is the deficiency from the consultant / employer side, can i take some legal action against the consultant / employer for refund of the H1 filing fees?
Please advice.
Thanks in advance.
