I have a strange problem. I was laid off and immediately got an another job.But the hiring process took so long that I am branded out of status.That is because my previous employer filed for bankruptcy and my severance was to be decided by court.Therefore no recent paystubs. Also, I had my PD current for I 485 in March.The attorney said it was not possible to file my case.
My wife has an H4 to H1 petition and she is working for last 3 months.
But she has not got it stamped on the passport.I am instructed to file for H4 immediately to save my status and the atrtorney intends to apply for new H1B.Though there is lots of discussion about validity of H1B laid off workers , which has not become law yet.
We are planning to get it stamped either in Canada or Mexico.Is there any folks who have got stamped visas from h4 to H1 or H1 to H4 in these countries.My attorney suggested Mexico as he believed that processing in Canada is more complicated and has higher rejection rate.
What documents should I take.Please share your experience.We are planning to go by land (drive).Is there any problems.
