Hi,

I shifted job and transfered H1 over to the new company. The new company have me only the copy of the notice of Approval. They claim that the original of the notice of approval remains with them and it is mentioned in the notice itself that it should be with the emlpoyers all the time.

1) Is this true.
2) Are there any dis advantages of not having the original with me.
3) Is it not required to get a stamping next time I go out of the country as my visa is expired.

Please help

I just looked at my recent notice of approval. It says the employer keeps the upper portion, and the employee should get the bottom portion (with the I-94. My employer gave me the entire thing. But you must insist on getting the bottom portion as you need it when you depart, (turn in the i94 on the right) and when you apply for a visa (the personal record section on the left).

Good Luck

I work for an immigration lawyer. In the past, we gave the employers the top portion of the approval notice, and the employee keeps the bottom portion. As of recently we have just started giving the entire notice to the employee, and give the employer a copy. I think either way is fine. You do need the top portion though if you wish to travel.
