H1-B Layoff, change of status

When you are laid off from a XYZ Company, you lose your staus at that very moment /instance.
the question i have is if you apply for change of status or a transfer of H1-B within a stipulated times (15 days to 45 days) and you get a approved petition with a attached I-94 does it mean that INS has REINSTATED your STATUS which overrules your OUT OF STATUS ????

I dont think you lose ur status just because you lose ur job. You still have time to file for a transfer also your employer needs to cancel your H1 to really make you out of status. INS will not know of ur layoff until informed by ur employer.
