Hi,

I got laid off by company A in October. Got a job with Company B. Company B applied for my H1-B visa transfer. I started working for company B after the WAC came through INS. Now, after working for about 20 days, I got laid off as the parent company of company B cut down the funds. I was told by company B that they would not revoke my H1-B processing.

My H1-B visa came through and now this company B is creating problems. they are saying that they are not liable to give me my H1-B approval notice. I have got a job with Company C and in order to process my H1-B visa, they need the H1-B approval from company B. I called up company B again & again to ask about H1-B; But they told me that they would not entertain any of my calls regarding this topic H1-B.

I want you to please let me know if I am entitled to get the H1-B approval from this company B or not.

one more thing, company B asked me to start working even before they applied for my H1-B transfer. In total, I worked for \'B\' for about 2 months. They put me on payroll only after they got the WAC number. I was there on their payroll for about 3 weeks.

I really appreciate your help in this matter.

regards

hi,

company B is not liable to give u the h1 approval notice nor is the h1 approval valid if u received the notice after u got laid off. but u can do one thing which my friend had done in the past and it worked--write a letter to the ins with ur wac number and say that company b is not giving u the h1 approval notice--my friend\'s h1 gopt approved on it with recent pay stubs but no approval notice copy
