H1 B in Process and OPT expires.. Wht to do?

Dear Readers,

I have a huge problem & I need legal advice for that. My employer has filed my H1-B in July 2006 and it's in the process (Regular Processing). Now, my OPT which has started in Dec 2005 is ending on 24th Dec., 2006.

Beacuse USCIS needs some extra information and it will be again in the process by 7th Dec., 2006. and get approved by 20th Jan, 2007.

My questions:

1. Can I stay in US after 24th Dec, 2006 without any hurdles legally?
2. If I stay, will it be legal or illgeal?
3. Do I need to get new I-20?
4. Can I work and get paid legally?

If any of this answer is no, what should I do?

Any help will be appreciated in this matter.

I believe you can stay in this country legally for 30 or 60 days after opt expiration. Of course with H1 still in process I think you might have to go off the companies payroll after your opt expires till you get your H1B. Again this is just from what I have seen and heard around here.

The H-1B visa is designed to be used for staff in "specialty occupations", that is those occupations which require a high degree of specialized knowledge. Generally at least the equivalent of a job-relevant 4-year US Bachelor's degree is required (this requirement can usually be met by having a 3-year degree and 3 years' relevant post-graduate experience).
