I am having a very peculiar issue with my H1-B status and I would like to get your suggestion / advice. My company filed for my H1-B extension (Last term) earlier this year and it was approved in 15 days. Parallel to my H1-B extension, they also filed for my I-140.
After 2 months, USCIS deployed 2 immigration officers to my company to verify my employment details because they claimed that there is some discrepancy between my I-129 and I-140 petition. My company told me that they accidently filed for a wrong LCA for my H1-B extension and the issue was corrected.
I just went back for for my stamping recently and faced quite a bit of issues with the officer because he was telling me that there were immigration officers deployed on your case and it looks like your H1-B is under review and we cannot approve this Visa. I was given a yellow form and was told to wait until they validate some information from DHS. I got a call 2 days later from the US Embassy to bring my passport over for the stamping and it was successful.
I just re-entered the county yesterday and I was held under investigation for 5 hours under the secondary Passport review. I am not sure what is showing up in the computer on my profile but they were making a few calls back and forth to USCIS to validate and they came back and told me that although USCIS has issued the H1-B extension visa, they have placed your Visa under review thinking that you are not Legitimate due to the fact that I have a discrepancy of information between my I-129 and I-140. They are not releasing any other information apart from that and I was released under Parole pending further investigation since they cannot validate my H1-B status.
I was given a date to appear in the local Immigration office in November to defend my case. I have been working for the past 4+ years after completing my Bachelors and Masters here in the US and I have had no issues in the past (Never been out of status). I was thinking on bringing the following documents to defend my case;
1. University Degrees
2. Past Employer I-129 Petition
3. Past Employer W-2
4. Past Employer Pay Stubs
5. Current Employer I-129 Petition (Innitial and Extension)
6. All Current Employer W-2
7. Current Employer Pay Stubs
8. Perm Petition Documents
9. I-140 Petition Documents
Has anyone here has experienced any similar issue? any thoughts on how I should proceed with this? I am thinking of making an appointment with Sheila Murthy to get her professional advice.
