H1-B Extension is required ?

Hi all,

I filed concurrently (I-140/I-1-485/AP/EAD) on Oct 31 2003 , EAD and AP or approved on March 8 2004 , March 13, 2004 , for my family I filed (I-485/AP/EAD) in Feb 13 2004 , nothing is approved yet, mean while my H1-B visa expires in June 06 2004 by which 5 yrs will be completed.

· Is it required to apply H1-B extension or not ?
· If I don’t apply for the ext. and my family didn’t get EAD/AP till June 06 2004 are they in legal status.
· I am planning to move to diff co. after my I-140 is approved , is it worth apply for H1-B ext. (for H1-B ext. I have pay from my pocket ) ?

No, it's not required to file for H1 extention if your I-485 is pending. But it's a good idea to file H1 extesion till your I-140 is approved.

Yes they are legal. Pending I-485 keeps your stay legal.

Is it worth: I would say yes till you get I-140 approval.

Thank you, can I apply after May 15 th ? hoping I-140 will approved before May 15th , then I will be luckiest person in the world :cool:
