I'm currently in my 6th year of H1-B visa and will be completing 6 years in June 2007. My employer has currently filed my PERM GC processing.
My case details are as follows:
- LCA was filed in May 2006
- LCA was approved in June 2006
- I-140 was filed.in July 2006
With an expedite processing of I-140, my case would be approved by Jan 10th 2007. My H1-B is up for extension sometime in Feb 2007.
Today, my employer has notified me that all IT positions are outsourced and my last day at the company is Jan 15th 2007.
I spoke to a consulting firm to transfer my H1-B visa and file for my GC immediately. The earliest the consulting firm can file for my GC is Mar 2007 after advertising for the position.
In this event, can the consulting firm apply for my 3 year extension since my I-140 was approved by the previous employer?
