I am nearing my 6 year H1-B term (in April 2003). My company has filed my LC in RIR category which was received by GA SESA on November 29th 2001. I don\'t have any notification from GA SESA, but my attorney says that they (GA SESA) are currently processing 04/01 cases. The backlog is due to the 245(i) cases.
If I don\'t get approval by November end this year, can I file for my H1-B extension beyond 6 year as per the new law (passed by Bill Clinton), or I have to have my I-140 filed before I can file for extension?
Any reply on this would be appreciated.
