H1-B expiring while waiting for labor cert

Hi everybody,

My H1-B is expiring on Jan 2005 (6 years..) and I am still waiting for my labor cert in Atlanta DOL, received date is Jan. 21, 2003. What option I have to stay in US after my H1-B is expired on Jan next year?

You will need to file for yearly extensions.

I asked my laywer for H1B expiration, she said you could expire not H1B after 365 days pending status.
