H1-B expiring dilemma... PLEASE ADVICE!!!

I'm in a TRIVIAL situation.

I'm in my 6th yr of H1-B. I joined my present company in Feb on a project for 6+ months. They applied for H1-B and aslo filed for recaliming time I spent outside US in the last 6 yrs. that would take me all the way till 30 Sep, 2003.

My H1-B got approved finally on 08 Aug,03 and my company informed me last week that the INS/BCIS gave approval for H1-B extennsion till 30 Sep,2003.

But Today my company informed me that the H1 approval is till 08 Sep, 2003 ONLY. I'm in a dilemma now since the project is still on. The client doesn't know about this and my company will probably not allow me to work after 08 Sep, 2003 which is understandable.

I want to stay in US for couple of months since I recently had a Baby and I want to get the initial Immunizations done before I leave US. Also need some time to wind up the stuff and visit some places.

Can someboy advice what's the LEGAL way to go about informing INS/BCIS. Can I just write a letter to INS saying that I need some time to wind up the stuff and wait for my Baby's immunizations.....

Any advice or somebody in a similar situation.....

Can I file Form I-539 or do I need a lawyer for filing?
I saw that Form I-539 requires me to send copy of I-94 which will expire on 08 Sep,2003. How will it effect the application process.

What proof can I have (or keep) to show that I filed for change of status to B-2 and that I'm not taying illegally in the country. Does INS/BCIS send a receipt or letter?

Also, when I finally leave US in Oct, the Airlines will take my (expired) I-94. Will it raise any RED FLAGS at the airport? Can this get me into some sort of trouble particularly with INS/BCIS getting tough nowadays?

Any experiences/advice.....

Would'nt it be good for you if BCIS does not allow you to leave :rolleyes: :D

Alren - That would be awesome. Wouldn't it.

Will BCIS get emotional f I tell them that my baby was born on Independence Day. That's the only way I can stay. But, probably it doesn't work that way.....

MOST URGENT HELP NEEDED.....

I need to apply by today 5pm. (LESS THAN ONLY 2 hrs LEFT).

Filing for change of status from H1-B to B2 (Form I-539)


I read the form and it states that :

H-1 applicants do not file an I-539 to effect a change in their status. The H-1 petition comprehends the change of status application. Dependents who require a change of status to H-4, however, should complete this form. The name of the eldest dependent goes on page one, and other dependents are included in the supplement.

What should I do???
Also, the form doesn't state where you should file if you live in WA.

Any help is appreciated.
