I am currently on H4 and my wife's H-1B is expiring this December (6 yr term).
India Option :
She works for Company A, that has a branch in India. Her I-140 is approved with priority date July 2008, she is waiting for priority date to become current.
Meanwhile I was wondering if it is possible for Company A to transfer her to India for an year and still keep the Green card Status intact and come back to US?
Current Issue :
She is in her Third Trimester and her project got completed recently. Currently when she is trying for jobs, it is becoming difficult to get one as she is near her delivery (due date : this Oct) and Clients are not considering her for the position.
H1 Renewal :
Company A says it will renew her H1 Visa for another 3 yrs, as my wife has her I-140 approved, but they can do it only in October, and I think she has to have a client letter for the renewal. How sooner/later can a Company file for renewal ?
What do you think are better options for us during this situation?
