H1 B cap-Please respond soon

Hi,

We were in the U.S. for 7 years and got back to India in Jan 2003. My husband is planning to come back again this year through another company(Company B).

If the Company B applies for a new H1 in April 2005:

1. Do we come under the H1 B cap?

2. Should he come only after Oct 2005 to U.S.?

---needs to be approved in order for him to get here.

sorry it was Jan 2004 that we got back and not Jan 2003. I guess we r still safe right?
