I was approved on H1B October 2008
Employer has been paying me 33% less then the prevailing wage listed on LCA since then.
I understand now that I am out of status while being paid less then prevailing wage.
If I find a new company am guessing H1B transfer will only be approved for consular processing? Will I have problem getting visa because of this?
While working in current company it is very hard to look for job. If I leave my current company, and find a new job lets say just before visa expires (Oct 2011) and go to consular processing, will I have problem getting visa (because of 1.5 yrs of being underpaid and 1.5 yrs of being without job?)
