I'm currently on a L1A [Earlier had L1-B]. Now a prospective employer is willing to do a L1-H1 transfer / COS. My question is can the AC 21 clause that if a person be not eligible for new 6 year term then they should not be counted towards the CAP. Since I've spent about 3 years in the L1 [both A and B] together, will my case be eligible to not be put under CAP, thus allowing me to start before the October? Please advise.
