H1-B 6 yrs expiring...pls.help

Hi,

My 6 yrs on H1-B visa are expiring in Jan 2004. I am working with company A and they have filed my LC and it is pending from 18 months(date has not moved at all).
Now another company B is ready to file my H1-B and LC from some fast state and I am planning to quit company A .

Pls advise me on the following :-

1) What will this company do for H1 - will it be a H1-B transfer or 7th yr H1 extension ?

2) Can this company B file a new LC based on pending LC from company A.? What docs are needed for this?

Also my present company A has only given me my case number(on attorney letterhead ) of LC and I don't have any other docs.

Pls. advise me.

---- IF u apply before Jan 2004, Comapny B can apply H1 transfer.
unless company A revoke/withdraw the LC application, you can get 7 year extension based on first company pending LC.

2) Can this company B file a new LC based on pending LC from company A.? What docs are needed for this?

----------- Same documents as new H1 application, except for covering letter asking for 7th year extension and do not forget to mention the law wich allowes this provision. You have to attach a reciept from dept of state showing your LC application reciept date as proof to your LC >365 days pending

If the company B file for H1 transfer, then that H1 would be valid for how long ? My guess is only till Jan 2004 (when 6 yrs r expiring) . Pls correct me.
Can company B directly file for 7th yr extension based on company A LC pending > 1 yr.

Yes! they can apply.... for 7th year as your 6 years is ending in jan 2004 that less than six months from now....


so Company B can do wonders for u
