Hi,

I got my H1-B visa in Nov 1998, and my company did not place me till July 2000. All the time I was working in India and waiting for my employer to find position for me.

My Question here is will my 6 years stay in US be considered from the time I got visa or the time I came to US.

Thanks
Ravi

It should be counted from the time you entered the US. You will have to apply for a visa renewal after your current Visa expires though which is usually after 3 yrs from the date it was issued (not from the time you entered).

H1B Six year count.

Hello .

My H1B was approved in May 1998 and took up Job in US in May 1998.
My first H1B expired in Dec 2001. My second extension expires in Oct 2003. They dont approve for full 3 years exactly.

Strictly my six year limit ends in May 2004.

Q1. How is this period, Oct 2003 - May 2004 to be treated as ? Is it a normal extension of H1B within six year rule ? Can my employer ( remains the same throughout ) apply for normal extension till May 2004 ? I do hold EAD and have not changed over to it.

Q2. When does the question of 7th Year extension start ? - May 2004 onwards ?
