H1/AOS status questions

Folks,

I filed I-140/I-485 concurrently. I have a valid H1 until 2006 but used AP for travelling. My wife is using her EAD and is also. If for some reason the I-140 and I-485 get and RFE/get denied do I lose status right away or does one get a couple of days to go out of the US and re-enter on H1 status. Our H1/H4 stamp expired on April 30, 2004.

If you are currently working for the same employer who did your H1, you are fine.

Your wife might needs to enter again as H4.

what if a h1 person has visa stamp based on company x and working for company y and GC sponsored by company y
