H1 and OPT

hi all,

Could anyone answer my following question. Would really appreciate..

1.) If company A has applied for my H1B visa and i am on my OPT, and my visa is yet to come, then i can work for some other employer on OPT( because A cant find me a project or i am on bench). Is that correct? The moment an H1 visa comes( filed by A) does it cancel the OPT using which i was working for B. Can i not keep working on my OPT and transfer my visa to B gradually?

THIS IS WHAT I UNDERSTAND AND COULD BE WRONG. I think you gotta be careful about the timeline, as you can't be on two different status simultaneously. The H-1B by Company A cancels OPT when it's ACTIVATED--note that the date it's ACTIVATED will be earlier the day you actually receive the H-1B visa in your hand. You must stop working for Company B on OPT before your H-1B is activated.

This part is unclear to me. Do you eventually want to work for Company B with H-1B sponsored by Company B? What do you mean "gradually"? When it comes to the immigration status, things become valid or invalid on precise dates; nothing will happen "gradually," I think.

Yes, i eventually want to work for B with Visa sponsored by B.

Having joined on OPT how do i get my visa transferred to B, if it hasnt come yet.( the visa could come anyday suddenly and cancel off my OPT using which i am working for B). How do i handle this unforseen situation?

And if the H1 has already come, then since my OPT with B has cancelled, then B should apply for a transfer. My question is that should the transfer be approved before i start working for B, or i can immediately start working once the transfer is appliedf for.

How long does it take to get a transfer?
How much would company A be involved in the transfer? Do i need any approval docs or something like that or anything else?
