Hello Experts

I am on an H1B Visa and my wife on H4 Visa.
We both have our passports stamped with my previous Employer's Visa and that is valid till may 2004. I changed my employer in Feb this year and have my approval notice(I-797) valid till Feb 2006 and my wife's I539 also valid till Feb 2006. We are going to India in Nov and coming back in Dec End and I was planning to get my and my wife's visa restamped. Here are some things I wanted to make sure.

1. Can I use Drop Box service as we will be getting stamping done in the same class.

2. As my old visa is valid till May 2004 , can I just skip the stamping part (I have heard the visa should be valid for 180 days when you enter US and mine will be less than 180 days)

3. If in some case they refuse to stamp or if it is denied I can still enter US on my old visa. I am not sure if they will invalidate it even if they don't stamp a new one.

4. Are there any precautions or documents that I need to take when I go for restamping.

Thank you guys. All your help is appreciated.

First of all i strongly suggest you not to go for stamping it self in india for you and for your wife ..
you can go to stampign if you have all the documentation .

Hi

Thanks for the reply.

I do have all the documentation and I have got my visa revalidated earlier using drop box without any problem but that was in 2001 and since then lots of rules have changed.

Also if my wife already have H4 stamped on her passport, do I need to carry marriage pictures, card n marriage certificate n all that stuff again??

I have read in some forums that people take their elec, phone bills, lease etc. Isn't W2 's for previous years be sufficient ??

See what documents you carry .. that is the authenticity of proff that you stying in status . and you are not in out of status.. and at the same time .. if you are going to for stamping in india either ofr you for your wife .. Check your LCA and W2 shows the correct amount of value .. and if you are out of job for any reason and if your w2 and LcA shows different values .. you just think about staying back in india or your wife ...
