Dear Great guru,

I hope that you can help me. I have consulted two attorneys regarding my situation and both said that they were not sure and were not able to provide any legal advice.

I am currently in my sixth year of H1B. In Aug this year, my company has filed for the 7th year extension due to pending labor decision (for more than 1 year) and I have received the approval. Unfortunately, recently, my company has announced that they will shut down in Dec.

My question : Can I convert to H4 after the company closes? What options do I have if I cannot be converted to H4? Do I need to leave the US for one year to reset the H clock?

FYI, my husband is on his 4th year of H1B. His labor cert was filed in June 2004.

Thank you in advance.
