I'd appreciate if someone can help me regarding the following :
I am a legal permanent resident living in US and considering marriage in few months with a gal in India. I am aware of the visa restrictions and the problems facing LPRs in terms of living with spouse ,while her application for immigration is pending.
1) Can she come to USA on H1 visa after our marriage ? Will her chances of getting H1-B approved decrease ,even if we do not apply for her immigration at this point of time. I'd rather wait till I become a US citizen ,to apply for her greencard , if that is the case.
2) I think her application for F1 and B2 are going to be denied at the US Embassy,India , after our marriage as they are pure 'non-immigrant' as opposed to H1-B which is dual-intent non-immigrant visa. Please confirm.
3) Assuming she can get her H1-B before our marriage, and she goes to US with me, Can we apply for her immigration without her status being affected , unlike F1 ?
